Complaints procedure

1. Reporting a defect

Report a defect to koval@elektropohonyslovakia.sk, by post, or in person by arrangement at Ružová 653/17, 067 83 Kamenica nad Cirochou, Slovakia. To speed up handling, provide the catalogue number, invoice or contract number, delivery date, description of the defect and contact details.

2. Statutory consumer rights

The seller is liable for a defect present on delivery that becomes apparent within two years. A defect appearing during this period is presumed to have existed on delivery unless the contrary is proved or the presumption is incompatible with the nature of the item or defect. Under current Slovak law, the liability period is extended by 12 months after the first repair; this occurs only once.

3. Reporting deadline

Consumers should report a defect within two months of discovering it and no later than the end of the statutory liability period.

4. Remedies

Where the seller is liable, a consumer may seek repair or replacement under statutory conditions. A proportionate price reduction or withdrawal may be available if repair or replacement is unavailable or not completed properly and on time. The seller may refuse a requested remedy if impossible or disproportionately costly compared with the alternative under statutory criteria.

5. Confirmation and timing

The seller promptly issues written confirmation of the defect report and states a remedy period. It is normally no more than 30 days unless an objective reason beyond the seller’s control justifies a longer period.

6. Professional installation

Damage from improper supply, wiring, exceeding rated parameters, unsuitable conditions, unauthorised intervention or ignoring the manufacturer’s instructions must be distinguished from a product defect. This does not affect statutory buyer rights where the cause is the responsibility of the seller or product.

7. Rejection

If the seller denies liability, the reasons are given in writing. Subject to statutory conditions, a consumer may establish liability by an expert opinion or assessment and report the defect again.

8. Business buyers

For B2B purchases, liability and any warranty are governed mainly by the Slovak Commercial Code, the quotation and manufacturer or distributor conditions. The consumer two-year regime does not automatically apply to businesses.
